By ordering a product or service through the Brysons Website, you shall be deemed to have read, understood and agreed to our Website Terms and Conditions.

We may change these Website Terms from time to time. You will be bound by changes even if you do not re-visit this page to re-read this notice.

Product Service and Description

We have taken reasonable precautions to try to ensure that prices quoted on our Website are correct and that all products have been fairly described. However, when ordering products or services through the Website please note that:

  • orders will only be accepted if there are no material errors in the description of the goods or services or their prices as advertised on this Website;
  • all prices are displayed in pounds Sterling inclusive of UK VAT where applicable unless expressly indicated otherwise;
  • packaging may vary from that shown on the website;
  • the weights, dimensions and capacities shown on the Website are approximate only;
  • whilst we try to display the colour of our products accurately on the Website, the actual colours you will see will depend on your monitor and we cannot guarantee that your monitor’s display of any colour will accurately reflect the colour of the product on delivery;
  • all items are subject to availability. We will inform you as soon as possible if the product(s) or service(s) you have ordered are not available and we may offer an alternative of equal or higher value.

Gift Messages

If you order a product or service as a gift for a friend or relative, we may offer you the opportunity to add a gift message to your purchase. If you choose to use the gift message service, you acknowledge and agree that:

  • the gift message service is provided for your own personal and non-commercial use only;
  • the gift message you instruct us to send on your behalf to a third party will not contain anything which could be construed as harassing, threatening, vulgar, abusive, obscene, defamatory, racist or which may cause embarrassment or distress to any person or which is otherwise unlawful or objectionable;
  • you will not impersonate any person, including but not limited to any of our employees or customers;

The Contract

Please note that completion of the on-line checkout process does not constitute our acceptance of your order. Our acceptance of your order will take place only when we despatch the product(s) to you. Brysons must receive payment of the whole of the price for the goods that you order before the product(s) are despatched.

All payments shall be made in Sterling. Once payment has been received, we will confirm that your order has been accepted by sending an email to you at the email address you provide on the order form. Brysons acceptance of your order brings into existence a legally binding Contract between you and Brysons. No variation of the Contract shall have effect unless agreed in writing by you and Brysons.

Price and Payment
The prices payable for Goods and Services that you order are set out in our Website, and are inclusive of UK mainland delivery. You will be required to pay extra for delivery to Europe and the Rest of the World. Price and availability of goods is subject to change without notice.

Brysons accepts Visa, Mastercard, Switch, Solo and Maestro credit/debit card payment. Brysons also accepts Google Pay and Apple Pay.

Credit Card Security

During the checkout process, you will be asked to complete your payment details. All fields indicated as compulsory must be completed. Please note that we will collect and store your information using an encrypted secure payment mechanism. They are only decrypted after they reach our computer and are not held in clear text on any part of the Website.

You are entitled to cancel any payment due to be made in respect of your order in the event that you discover that your card has been used fraudulently by any unauthorised person to buy goods under this Contract. Your card issuer will be liable to re-credit your debit, credit or payment card in respect of any sums already paid.

If you do discover that fraudulent use has been made of your card you should immediately notify us and your card company with full details.

We take payment when we accept your order shortly before despatch. If your payment is not received and you have already received the products you ordered from us, you must pay for the products or return those products to us in accordance with reasonable return instructions that we provide to you and in the same condition that you received them at your own expense. We reserve the right to charge you for any and all damage to (or other adverse interference with) any products that are the subject of an unpaid order.

If we cannot supply you with the product or service you ordered, we will not process your order, inform you of this in writing (including e-mail) and, if you have already paid, refund in you full as soon as reasonably possible.

Delivery

All prices quoted included UK mainland delivery charges. Delivery charges and timescales to Europe and the Rest of the World vary depending upon the value and size of the products you have ordered, and their destination.

You will become the owner of the goods you have ordered when they have been delivered to you/your designated delivery address. Once the goods have been delivered to you they will be held at your own risk and Brysons will not be liable for their damage, loss or destruction.

We shall be under no liability for any delay or failure to deliver products if the delay or failure is wholly or partly caused by circumstances beyond our control.

Liability

All products are sold in accordance with the Brysons specification contained in the Website. Brysons warrants that the products will correspond with their specification in the website but does not make any other promises or warranties about the goods.

You have certain rights as a consumer, including legal rights relating to faulty or misdescribed goods. For further information about your legal rights in the UK, contact your local authority Trading Standards Department or Citizens Advice Bureau. Nothing in these General Terms and Conditions will affect these legal rights and, in particular, we will perform our obligations under these General Terms and Conditions with reasonable care and skill.

Brysons shall be under no liability under the above warranty (or any other warranty, condition or guarantee) if the total price for the Good(s) has not been paid.

If the goods we deliver are not what you ordered or are damaged or defective or the delivery is of an incorrect quantity, Brysons shall have no liability to you unless you notify us within 7 working days of the delivery of the goods in question. If you do not receive goods ordered by you within 30 days of the date on which you ordered them, Brysons shall have no liability to you unless you notify us of the problem within 40 days of the date on which you ordered the goods.

If you notify a problem to us under this condition, our only obligation will be, at your option:

  • to make good any shortage or non-delivery
  • to replace or repair any goods that are damaged or defective
  • to refund the amount paid by you for the goods in question in whatever way Brysons choose.
  • Save as precluded by statutory law, Brysons will not be liable to you for any indirect or consequential loss, damage or expenses (including loss of profits, business or goodwill) howsoever arising out of any problem you notify to us under this condition.

Brysons shall have no liability to pay any money to you by way of compensation other than to refund to you the amount paid by you for the Goods in question.

You must follow any advice given to you to keep the products we supply to you safe. We cannot accept liability for damage to products we have supplied which is caused by your failure to follow this advice. You must observe and comply with all applicable regulations and legislation, including obtaining all necessary customs, import or other permits to purchase goods from our site.

The importation or exportation of certain Brysons goods to you may be prohibited by certain national laws. Brysons makes no representation and accepts no liability in respect of the export or import of the Goods you purchase.

Brysons shall accept no liability for the use of the Goods by you other than in accordance with Brysons’ instructions. Notwithstanding the foregoing, nothing in these conditions is intended to limit any rights you might have as a consumer neither under applicable local law or other statutory rights that may not be excluded nor in any way to exclude or limit our liability to you for any death or personal injury resulting from our negligence.

You will indemnify Brysons against all loss damages, costs and expenses awarded against or incurred by us in connection with any claim paid or agreed to be paid by Brysons as a consequence of the Consumer Protection Act 1987.

Brysons shall have no liability to you for any failure to deliver Goods you have ordered or any delay in doing so or for any damage or defect to Goods delivered that is caused by any event or circumstance beyond our reasonable control including, without limitation, strikes, lock-outs and other industrial disputes, breakdown of systems or network access, flood, fire, explosion or accident.
